*NOTICE TO THE PUBLIC:* The Code of Judicial Conduct governing behavior by judges forbids the Judges of the Fifth Judicial Circuit to discuss pending cases with the public. Please do not call the Court expecting to speak with a Judge about any case. The Court is only allowed to consider arguments made in the courtroom and in documents properly filed by actual parties in the case as authorized by law and the Rules of Court. The Court cannot ethically read or consider any other opinions or arguments about the case. Communications that do not meet these legal requirements cannot be forwarded to the Judges.

SUBMITTING PROPOSED ORDERS BY EMAIL

**IMPORTANT NOTICE REGARDING SUBMISSION OF PROPOSED ORDERS**

The case style, including case number, shall be indicated in the subject line.  

PLEASE SUBMIT ORDERS IN WORD FORMAT (.docx) ONLY

(NO WORD 97 OR PDF DOCUMENTS WILL BE ACCEPTED)

Any email submission shall copy ALL parties by email. If one or more of the parties do not have an email, your correspondence shall indicate that a copy has been mailed to those parties.

The following verbiage must be added to all documents submitted by email, on cases that have pro-se parties:

It is FURTHER ADJUDGED that within 5 days from the date of eservice of this Order/Judgment, the plaintiff shall 1. Furnish a copy of this Order/Judgment to each self-represented party by U.S. Mail, first class, postage paid; and, 2. File a certificate signed by the Plaintiff or, if represented, Plaintiff’s counsel that delivery of this Order/Judgment has been made as set forth herein.

For documents that are mailed in (20 N. Main St., Room 359, Brooksville, FL 34601) for Judge’s signature AND that have pro-se parties, you MUST include pre-paid self-addressed envelopes with the appropriate number of copies to be conformed. 

All motions are required to be e-filed and e-served appropriately, prior to proposed orders being sent in. 

Please note that failure to comply with the above procedures will result in the Proposed Orders being Rejected and a delay in processing your case(s).

HEARING REQUESTS

Please use the following email address to request a hearing date:  jclay@circuit5.org OR by calling 352-754-4170.

After a hearing is set and confirmed by the Judicial Assistant, it will not appear on the clerk docket until the Notice of Hearing is filed.

HEARING CANCELLATIONS

A Notice of Cancellation must be e-filed with the Clerk’s Office no later than 24 hours prior to the scheduled hearing time.  If the hearing to be cancelled is within 5 business days of the scheduled hearing, you must emergency e-file the Notice of Cancellation and send a courtesy copy to JoAnne Clay at jclay@circuit5.org
